The following cases were recently acted upon in Circuit Court, Criminal Division.

Controlled substance

Cody S. Hill of the 3900 block of Highway M pleaded guilty July 2 to the Class D felony of possession of a controlled substance.

The court suspended the imposition of his sentence and placed him on five years’ supervised probation.

The court ordered he pay $46 to the Crime Victims’ Fund (CVF) and $300 to the Butler County Law Enforcement Restitution Fund, complete 100 hours of community service and successfully complete an alternative services program.

Stalking, burglary

Rodney A. Brown of the 700 block of North 12th Street was sentenced July 2 after earlier pleading guilty to the Class E felony of first-degree stalking and the Class B felony of first-degree burglary.

The court sentenced him to four years in the Missouri Department of Corrections and ordered he pay $46 to the CVF on his stalking case.

The court also sentenced him to six years in prison and ordered he pay $68 to the CVF on his burglary case.

The court ordered Brown’s sentences to be served concurrently.

DWI

Robert Joseph Lowery of Doniphan pleaded guilty July 9 to the Class E felony of driving while intoxicated.

The court sentenced him to four years in the Missouri Department of Corrections, with suspended execution of his sentence, and placed him on five years’ supervised probation.

The court ordered he pay $46 to the CVF, $300 to the Ripley County Law Enforcement Restitution Fund and $10,329.12 in restitution to be paid at the direction of his probation officer; complete 480 hours of community service; and enter and successfully complete the Veterans’ Court Program.

Controlled substance

Bruce Lee Scarbrough of Sikeston pleaded guilty July 9 to the Class D felony of possession of a controlled substance.

The court sentenced him to six years in the Missouri Department of Corrections, with suspended execution of his sentence, and placed him on five years’ supervised probation.

The court ordered he pay $46 to the CVF and $300 to the Butler County Law Enforcement Restitution Fund.

Burglary

Artis Eugene Larue of the 2100 block of Wood Street pleaded guilty July 9 to the Class D felony of second-degree burglary.

The court sentenced him to seven years in the Missouri Department of Corrections and recommended he be placed in a 120-day shock incarceration program, with a bed date of Aug. 21.

The court ordered he pay $46 to the CVF.

Arson

Susan M. Tippen of the 1500 block of Truman Street pleaded guilty July 9 to the Class D felony of second-degree arson.

The court sentenced her to six years in the Missouri Department of Corrections, with suspended execution of her sentence, and placed her on five years’ supervised probation.

The court ordered she pay $46 to the CVF and $300 to the Butler County Law Enforcement Restitution Fund.

Bad checks

William A. Grubb of the 1300 block of Benton Street was sentenced July 15 after earlier admitting to violating his probation on the Class D felony of non-support and three Class C felonies of passing a bad check.

The court revoked his probation on the non-support charge and ordered the execution of his previously suspended four-year sentence in the Missouri Department of Corrections.

The court also revoked his probation on the check charges and sentenced him to seven years in prison on each count. The court ordered the sentences to be served concurrently and concurrent to sentence in the non-support case.

Stealing

Gary Edward Goforth III of Oxly pleaded guilty July 16 to the Class D felony of stealing.

The court sentenced him to seven years in the Missouri Department of Corrections, with suspended execution of his sentence, and placed him on five years’ supervised probation.

The court ordered he pay $46 to the CVF and $5,001.42 in restitution at $150 per month, beginning Sept. 1.

Stealing

Simon J. Clark of the 2000 block of Broadway pleaded guilty to the Class D felony of stealing leased or rented property.

The court sentenced him to six years in the Missouri Department of Corrections, with suspended execution of his sentence, and placed him on five years’ supervised probation.

The court ordered he complete 100 hours of community service and pay $46 to the CVF; restitution of $1,375 at $100 per month, beginning Sept. 1; and $200 per month in current child support and after the first year, $200 per month in current child support and $100 per months in arrears.

Assault

Dawon Nicholas Harris Sr. of Dexter pleaded guilty July 16 to the Class D felony of second-degree assault.

The court sentenced him to seven years in the Missouri Department of Corrections, with suspended execution of his sentence, and placed him on five years’ supervised probation.

The court ordered he pay $46 to the CVF and $300 to the Butler County Law Enforcement Restitution Fund; enter and successfully complete a batterers’ intervention program and supervision under a domestic violence supervision agreement.

Assault, endangering child

Michael Bruce Rushing of the 400 block of Main Street was sentenced July 16 after earlier pleading guilty to the Class B felony of first-degree domestic assault and the Class D felony of first-degree endangering the welfare of a child.

The court sentenced him to 10 years in the Missouri Department of Corrections on the assault charge and recommended he be place in a 120-day shock incarceration program, with a bed date of Aug. 12. The court ordered he pay $68 to the CVF.

The court also sentenced him to seven years in prison on the endangering charge and recommended he be placed in a 120-day shock incarceration program, with a bed date of Aug. 12. The court ordered he pay $46 to the CVF.

The court also ordered Rushing’s sentences to be served concurrently.

Controlled substance, prior offender

Aaron M. Chance of Bernie pleaded guilty July 23 to the Class D felony of possession of a controlled substance.

The court sentenced Chance, who was charged as a prior and persistent offender, to 10 years in the Missouri Department of Corrections, with suspended execution of his sentence, and placed him on five years’ supervised probation.

The court ordered he pay $46 to the CVF and $300 to the Butler County Law Enforcement Restitution Fund and he successfully complete the Stoddard County alternative services program.

The court ordered Chance’s sentence to run concurrently with any other sentence he currently is serving.

Stealing, prior offender

Dennis Hanks of St. Louis pleaded guilty July 23 to the Class D felony of stealing.

The court sentenced Hanks, who was charged as a prior and persistent offender, to seven years in the Missouri Department of Corrections. The ordered his sentence to be served concurrently with any other sentence he currently is serving.

The court also ordered he pay $46 to the CVF and $5,000 in restitution to be paid upon his release.

Michael David Gilmore of the 1300 block of Benton Street pleaded guilty July 23 to the Class D felony of possession of a controlled substance.

The court suspended the imposition of his sentence and placed him on five years’ supervised probation.

The court ordered he pay $46 to the CVF and $300 to the Butler County Law Enforcement Restitution Fund and he complete 100 hours of community service.

Failure to register as sex offender

Tracy B. Hill of Neelyville pleaded guilty July 23 to the Class D felony of failure to register as a sex offender.

The court sentenced Hill to three years in the Missouri Department of Corrections and ordered the sentence to be served concurrently with any other sentence Hill is currently serving.

The court ordered Hill pay $46 to the CVF.

Valerie Nichole Hobbs of Dexter pleaded guilty July 23 to the Class D felony of possession of a controlled substance.

The court sentenced her to seven years in the Missouri Department of Corrections, with suspended execution of her sentence and placed her on five years’ supervised probation.

The court ordered her sentence to run concurrently with any other sentence she currently is serving. She also was ordered to pay $46 to the CVF and $300 to the Butler County Law Enforcement Restitution Fund and complete 100 hours of community service.

Sale of controlled substance

Marion Y. Reed of Casa Grande, Ariz., pleaded guilty July 23 to the Class B felony of sale of a controlled substance.

The court suspended the imposition of Reed’s sentenced and placed Reed on five years’ supervised probation.

The court ordered Reed to pay $46 to the CVF and $300 to the Butler County Law Enforcement Restitution Fund and complete 100 hours of community service.

Jeremy Michael Vollet of the 900 block of Maud Street pleaded guilty July 23 to the Class D felony of possession of a controlled substance.

The court sentenced him to seven years in the Missouri Department of Corrections, with suspended execution of his sentence, and placed him on five years’ supervised probation.

The court ordered he complete 100 hours of community service and pay $46 to the CVF, $300 to the Butler County Law Enforcement Restitution Fund and $250 in restitution at $50 per month, beginning Sept. 1.

Jessica Diane Whaley of the 1200 block of Lester Street pleaded guilty July 23 to the Class E felony of third-degree assault.

The court suspended the imposition of her sentence and placed her on five years’ supervised probation.

The court ordered she to pay $46 to the CVF and $300 to the Butler County Law Enforcement Restitution Fund and complete 100 hours of community service.

Controlled substance, treatment program ordered

Adam Gregory Gilberto of the 700 block of North Ninth Street pleaded guilty July 23 to the Class D felony of possession of a controlled substance and the Class E felony of non-support.

The court sentenced him to seven years in the Missouri Department of Corrections, with suspended execution of the sentence, on the drug offense.

The court placed him on five years’ supervised probation and ordered he enter and successfully complete the John 3:16 drug treatment program. He also was ordered to pay $46 to the CVF and $300 to the Butler County Law Enforcement Restitution Fund.

The court sentenced him to three years in prison, with suspended execution of the sentence, on the non-support charge. The court ordered the sentence to be served consecutively to his seven-year sentence and placed him on five years’ supervised probation.

The court ordered he enter and successfully complete the John 3:16 drug treatment program. He also was ordered to pay $46 to the CVF, $300 to the Butler County Law Enforcement Restitution Fund and $600 (or current amount) plus $200 each month, to begin at the court’s discretion.

Child molestation, sex offender assessment ordered

Andre Carl Johnson of the 1800 block of Thomas Street was sentenced July 23 after earlier pleading guilty to the Class B felony of first-degree child molestation.

The court sentenced him to 12 years in the Missouri Department of Corrections and recommended he be placed in a 120-day sex offender assessment program. The court also ordered he pay $68 to the CVF.

Forgery

Curtis H. King of the 800 block of Highway T admitted violating his probation July 23 on the Class D felony of forgery.

The court revoked his probation and ordered the execution of his previously suspended five-year sentence in the Missouri Department of Corrections.

Andrew B. Lomax of the 3200 block of West Harper Street admitted violating his probation July 23 on the Class C felony of possession of a controlled substance.

The court revoked his probation and ordered the execution of his previously suspended five-year sentence in the Missouri Department of Corrections.

Burglary

Preston Shepherd of the 1500 block of Alice Street was found in violation of his probation July 23 on the Class D felony of second-degree burglary.

The court revoked his probation and ordered the execution of his previously suspended seven-year sentence in the Missouri Department of Corrections.

Domestic assault

Brittany E. Burkett of the 400 block of West Henry Street pleaded guilty July 30 to the Class A misdemeanor of fourth-degree domestic assault.

The court sentenced her to six months in the Butler County jail, with suspended execution of her sentence, and placed her on two years’ supervision through the Citizens’ Advisory Board.

The court ordered she pay $10 to the CVF and complete an anger management program.

Non-support

Timothy D. Daggs of Greenville pleaded guilty July 30 to the Class E felony of non-support.

The court suspended the imposition of his sentence and placed him on five years’ supervision probation.

The court ordered he complete 100 hours of community service and pay $46 to the CVF and $206 per month in current child support and $100 per month in arrears, beginning Sept. 1.

The court sentenced him to seven years in the Missouri Department of Corrections, with suspended execution of the sentence, and placed him on five years’ supervised probation.

The court ordered he pay $46 to the CVF and $300 to the Butler County Law Enforcement Restitution Fund.

Jill Denise Jones of Neelyville pleaded guilty July 30 to the Class D felony of possession of a controlled substance.

The court sentenced Jones, who was charged as a prior and a persistent offender, to eight years in the Missouri Department of Corrections, with suspended execution of her sentence, and placed her on five years’ supervised probation.

The court ordered she complete 100 hours of community service and pay $46 to the CVF and $300 to the Butler County Law Enforcement Restitution Fund.

Child pornography, sex offender assessment ordered

Jason Todd Birdwell of Qulin was sentence July 30 after earlier pleading guilty to the Class B felony of possession of child pornography.

The court sentenced him to seven years in the Missouri Department of Corrections and recommended he be placed in the 120-day sex offender assessment program. The court also ordered he pay $68 to the CVF.

Assault

Christopher M. Irvin of Qulin pleaded guilty July 30 to the Class A misdemeanor of fourth-degree assault.

The court sentenced him to one year in the Butler County jail, with suspended execution of his sentence, and placed him on two years’ supervised probation through the Citizens’ Advisory Board.

The court ordered he pay $10 to the CVF and complete 40 hours of community service and an anger management program.

Controlled substance, failure to register as sex offender

Linda Pearl Jones of the 700 block of West Vine Street admitted violating her probation July 30 on the Class D felony of possession of a controlled substance and pleaded guilty to the Class E felony of failure to register as a sex offender.

The court revoked her probation and sentenced her to four years in the Missouri Department of Corrections on the drug offense.

The court also sentenced her to four years in prison on her new charge and ordered the sentences to be served concurrently. The court also ordered she pay $46 to the CVF.
